Mustang Litigation Funding (“Mustang,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. It applies to www.mustangfunding.com and to our application, claimant, and attorney portals (together, the “Services”).
1. Information We Collect
Information you give us
- Contact and identity information — name, email address, mobile and other telephone numbers, mailing address, date of birth, and state of residence.
- Application information — the funding amount you request, and details about your legal claim, including case type, venue, stage, injuries, treatment, and the identity of your attorney and law firm.
- Verification information — government identification and, where required to fund or to meet legal obligations, a Social Security number.
- Documents you submit — including retainer agreements, medical records and bills, police or incident reports, pleadings, and correspondence.
- Communications — messages you send us by email, text message, web form, or telephone, including call notes.
Information we receive from others
- From your attorney or law firm, with your authorization — case status, medical and billing records, liens, and settlement information.
- From service providers who help us verify identity, screen for legally required watchlists, and confirm the information in your application.
Information collected automatically
- Device and usage data such as IP address, browser type, pages viewed, and referring page, collected through cookies and similar technologies.
2. How We Use Your Information
- To evaluate your funding application and underwrite, document, and service a funding transaction.
- To verify your identity and prevent fraud.
- To communicate with you and your attorney about your application and your case — including status updates, requests for missing documents or information, notices that a document is ready for electronic signature, appointment confirmations, and answers to questions you send us.
- To operate, secure, and improve the Services.
- To comply with legal and regulatory obligations and to establish, exercise, or defend legal claims.
3. Text Messaging (SMS)
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and service providers acting on our behalf solely to transmit the messages you have asked to receive.
If you provide your mobile number and affirmatively consent, we may send you text messages about your funding application and your case. Message frequency varies based on activity on your own application and case; we do not send recurring or scheduled broadcasts, and we do not send marketing or promotional text messages.
Message and data rates may apply. Consent to receive text messages is not a condition of submitting an application or of receiving funding.
You may opt out at any time by replying STOP to any message, after which we will send a single confirmation and stop sending texts. Reply HELP for assistance, or contact us at (844) 847-3152 or [email protected]. Carriers are not liable for delayed or undelivered messages.
4. How We Share Information
We do not sell your personal information, and we do not rent or share it with third parties for their own marketing purposes. We share information only as described here:
- With your attorney and law firm, as necessary to evaluate, document, and service your funding.
- With service providers who perform work on our behalf under contract — including messaging and email providers, electronic signature providers, document storage providers, identity verification services, and professional advisors. They may use your information only to provide services to us.
- With parties to your funding transaction, such as co-funders or successors, where you have agreed to the transaction.
- For legal reasons — to comply with law, subpoena, or regulatory requirement, to enforce our agreements, or to protect the rights, safety, and property of Mustang, our clients, or others.
- In a business transfer, such as a merger, acquisition, or sale of assets, subject to this Policy.
5. Data Retention
We keep personal information for as long as needed to provide the Services and to satisfy our legal, tax, accounting, and recordkeeping obligations, including the duration of any funding and any applicable limitations period. When information is no longer needed, we delete it or de-identify it.
6. Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and restricted handling of sensitive identifiers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Your Choices and Rights
- Text messages — reply STOP to opt out at any time.
- Email — use the unsubscribe link in any non-transactional email. We may still send you messages necessary to service an active funding.
- Cookies — most browsers let you refuse or delete cookies; some features may not work if you do.
- Access, correction, and deletion — depending on where you live, you may have the right to request access to, correction of, or deletion of your personal information, to request a copy in a portable format, and to appeal a denial. Residents of California, Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws may also have the right to opt out of sale or targeted advertising; we do not sell personal information or use it for targeted advertising. 8. Children’s Privacy
The Services are not directed to children under 18, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.
9. Third-Party Links
The Services may link to sites we do not control. This Policy does not apply to those sites, and we are not responsible for their privacy practices.
10. Changes to This Policy
We may update this Policy from time to time. We will post the revised version here and update the effective date above. Material changes will be communicated as required by law.
